Limits for Recovery on Overpaid Claims

An Insurance may not initiate overpayment recovery process from provider more than 18 months after the initial payment was received by the provider.

Additional Details

An insurer shall initiate any overpayment recovery efforts by sending a written notice to the provider at least 30 business days prior to engaging in the overpayment recovery efforts.

Exemptions

Excludes Fraud, abusive billing, and the government & self funded plans.
